SUBSTITUTED TRUSTEE'S NOTICE...

SUBSTITUTED TRUSTEE'S NOTICE OF SALE WHEREAS, on February 5, 2003, Ronald L. Rossetti and wife Judy L. Rossetti, executed a deed of trust to Arnold M. Weiss, Trustee for the benefit of Mortgage Electronic Registration Systems, Inc., which deed of trust is recorded as Instrument No. 030598 in the Office of the Chancery Clerk of the County of Union, State of Mississippi; and WHEREAS, the aforesaid deed of trust was assigned to Deutsche Bank Trust Company Americas as Trustee for RALI 2003QS6 by instrument dated January 21, 2010, and recorded in the Office of the aforesaid Chancery Clerk as Instrument No. 2010000324; and WHEREAS, the aforesaid, Deutsche Bank Trust Company Americas as Trustee for RALI 2003QS6, the holder of said deed of trust and the note secured thereby, substituted John C. Underwood, Jr., as Trustee therein, as authorized by the terms thereof, by instrument dated March 12, 2012 and recorded in the Office of the aforesaid Chancery Clerk as Instrument No. 2012000978; and WHEREAS, default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby, having been declared to be due and payable in accordance with the terms of said deed of trust, and the legal holder of said indebtedness, Deutsche Bank Trust Company Americas as Trustee for RALI 2003QS6, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust for the purpose of raising the sums due thereunder, together with attorney's fees, Substituted Trustee's fees and expense of sale; NOW, THEREFORE, I, John C. Underwood, Jr., Substituted Trustee in said deed of trust, will on the 29th day of May, 2013, offer for sale at public outcry for cash to the highest bidder, and sell within legal hours (being between the hours of 11:00 A.M. and 4:00 P.M.) at the Main door of the County Courthouse at New Albany, County of Union, State of Mississippi, the following described property situated in the County of Union, State of Mississippi, to-wit: Tract I: 13.4 acres, more or less, in the Northwest Quarter of Section 6, Township 7 South, Range 2 East, the same being more particularly described as Beginning at the Northwest Corner of the Northwest Quarter of Section 6, Township 7 South, Range 2 East, Union County, Mississippi, and run South with the Section line a distance of 950 feet, more or less, to the J. B. Mattox North property line; run thence East with the J. B. Mattox North property line a distance of 950 feet, more or less, to the West right-of-way line of County Road 515; run thence in a Northwesterly direction with the West right-of-way line of County Road 515 a distance of 1,200 feet, more or less, to the North line of said Section 6; run thence West with the Section line a distance of 250 feet, more or less, to the Point of Beginning. Tract II: 1.37 acres, more or less, in the Southwest Quarter of Section 31, Township 6 South, Range 2 East, the same being more particularly described as Beginning at the Southwest Corner of the Southwest Quarter of Section 31, Township 6 South, Range 2 East, Union County, Mississippi, and run North with the Section line a distance of 400 feet, more or less, to the point of intersection with the West right-of-way line of County Road 515; run thence in a Southeasterly direction with the West right-of-way line of County Road 515 a distance of 450 feet, more or less, to the South line of said Section 31; run thence West with the Section line a distance of 250 feet, more or less, to the Point of Beginning. Tract III: 3.9 acres, more or less, in the Northeast Quarter of Section 1, Township 7 South, Range 1 East, the same being more particularly described as Beginning at the Northeast Corner of Section 1, Township 7 South, Range 1 East, Union County, Mississippi, and run thence West with the Section line a distance of 300 feet, more or less, to the point of intersection with the centerline of a drainage ditch; run thence in a Southeasterly direction with the centerline of said drainage ditch a distance of 950 feet, more or less, to the point of intersection of the centerline of said drainage ditch and the East line of said Section 1; run thence North with the East line of said Section 1 a distance of 950 feet, more or less, to the Point of Beginning.
